Heppu AI chat: general terms of use

Heppu AI Oy ("Heppu", "we", "us" or "our") provides companies ("Customer") with an AI-based chat service that supports customer service and sales.

These terms of use ("Terms") apply to the use of Heppu AI Oy's chat service ("Service"). By using the Service, the user ("User") accepts the Terms and agrees to comply with them.

When using the Service, the User agrees to comply with the law and with these Terms. The Service may be used for lawful purposes only.

Using the Service for purposes that may cause direct or indirect harm to us, to our Customers or to third parties is strictly prohibited.

The Service should be used only to the extent that is necessary for customer service and sales from our Customer's point of view. Information given in the Service must be limited to what is needed to manage the customer relationship or to leave a contact request. Never give health data or other sensitive information in the Service.

The Service may be used only in the User's own name. Entering personal data of anyone other than the User is prohibited.

Data processed in the Service is always collected and processed on behalf of the Customer ("Controller") on whose website the Service is used. The Controller's privacy policy is available on the Controller's website. By using the Service, the User consents to the processing of their data in the Service. The Controller's other legal bases for processing are described in more detail in the Controller's privacy policy.

Heppu acts as a data processor under the Controller's instructions. Conversation history is stored in Heppu's system. Data obtained through the Service is collected and processed in the Controller's name and on the Controller's behalf. The data processing agreement between us and the Controller, and Heppu's privacy policy, are available on Heppu's website.

The User's rights regarding their personal data are described in more detail in the privacy policies of the Controller and of Heppu.

Heppu uses the latest language models, and they may make mistakes. Neither our Customer nor we are responsible for the answers the Service produces.

We develop the Service continuously and aim to keep it available at all times without interruption. Neither our Customer nor we are responsible for possible outages or for any harm they cause.

Neither our Customer nor we are liable for any direct, indirect, immediate or consequential damage arising from the Service, from its use or from the inability to use it.

All intellectual property rights related to the Service, including ownership and copyright, belong to Heppu AI Oy unless otherwise stated.

The Service and these Terms are governed by the laws of Finland.

If a dispute between the parties concerning the Service cannot be settled by negotiation, it will be resolved in the District Court of Helsinki as the court of first instance.

We have the right to change the Service and these Terms at any time and without prior notice. We reserve the right to suspend the provision and development of the Service for necessary maintenance and updates, and to discontinue the Service.

We reserve the right to transfer the Service and the rights related to it to a third party (for example in connection with a business acquisition) without the User's separate approval.
